Put it this way if you slept with a Skrull who impersonated your wife, would you feel violated once you found out? Probably. Would it be considered rape? Maybe. So there’d probably have to be some real cases in order to set legal precedent.

However I feel I could 100% get a rape conviction in this case against Doc Ock. because he used Peter Parker’s body for sex without his consent. Sex using someone without their consent and through any type of mind altering means is 100% fitting the definition of rape. And Pete was unable to consent to the use of his body by another person controlling him during sex. That’s rape. And saying Doc excised Pete from his body doesn’t wash. Just because you force my psyche out of my body or essentially make me brain dead doesn’t mean you get to do whatever you want with my body afterwards. No consent. Doc Ock raped Peter Parker. >
